Terms and Conditions for Ticket Sales

of the company Ing. Miroslav Orlík, with its registered office at Tyršova 530, 254 01, Jílové u Prahy, Company ID: 07240694, phone: +420 606 379 809, email: terrabazar@terrabazar.cz, info@botanickaburza.cz, for the sale of goods (tickets) through an online store located at the web addresses terrabazar.cz and botanickaburza.cz


1. Introductory Provisions

a) These terms and conditions (hereinafter referred to as “Terms and Conditions”) of the company Ing. Miroslav Orlík, with its registered office at Tyršova 530, 254 01, Jílové u Prahy, Company ID: 07240694 (hereinafter referred to as the “Seller”) regulate, in accordance with § 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the “Civil Code”), the mutual rights and obligations of the contractual parties arising from or related to the purchase contract (hereinafter referred to as the “Purchase Contract”) concluded between the Seller and a natural person (hereinafter referred to as the “Buyer”) through the Seller's online store. The online store is operated by the Seller on websites located at terrabazar.cz and botanickaburza.cz (hereinafter referred to as the “Website”).

b) These Terms and Conditions, together with the Complaints Procedure, define the rights and obligations of the Seller and Buyer related to the sale of tickets for any cultural, social, sports, or other events (hereinafter referred to as “Events”) through the online store.

c) Contacting the Seller means reaching an authorized person by phone, email, or via general contact details listed in the “Contacts” section of the Website.

d) These Terms and Conditions form an integral part of the Purchase Contract. By purchasing tickets, the Buyer acknowledges and agrees that these Terms and Conditions are part of the contractual agreement between them and the Seller.


2. Subject of the Contract

a) The subject of the contract is the Seller’s obligation to deliver the tickets to the Buyer for the selected Event, in the requested quantity, and the Buyer's obligation to pay the full ticket price.

b) The Purchase Contract is concluded when the Buyer pays for the tickets.

c) The Seller undertakes to deliver the tickets to the Buyer as soon as possible after payment. For online purchases, tickets are sent electronically to the email address provided by the Buyer. The Buyer is not entitled to receive the tickets until full payment has been made.

d) Once the Seller has delivered the tickets to the Buyer, all of the Seller's obligations under the Purchase Contract are considered fulfilled.

e) Tickets are not sent by mail, even on a cash-on-delivery basis.


3. Rights and Obligations of Contracting Parties Related to the Event

a) The Seller is the organizer of the Events for which tickets are sold. By purchasing a ticket, a contractual relationship is established between the Buyer and the Seller as the Event organizer. The Seller is responsible for fulfilling the obligations of the Event organizer under this contractual relationship.

b) By purchasing a ticket, the Buyer agrees to comply with the rules set by the Seller, as well as with the operational and visitor rules of the Event venue.

c) The Seller, as the Event organizer, reserves the right to change the Event program, date, or venue. By purchasing a ticket, the Buyer acknowledges this right.

d) The Seller is not responsible for the validity or authenticity of tickets purchased from third-party sources outside the Website.


4. Purchase Procedure and Payment Conditions

a) Ticket prices are listed individually for each Event, along with any additional fees.

b) Payments for tickets purchased through the Website can be made only by credit card or by bank transfer.

c) The Seller is not responsible for any fees charged to the Buyer by their bank or payment provider.

d) Tickets are not sent by cash-on-delivery.

e) Discount codes cannot be applied to VIP tickets.

f) In case of a consumer dispute from the Purchase Contract, the Buyer may contact the Czech Trade Inspection Authority (Štěpánská 567/15, 120 00 Prague 2, ID: 00020869, website: https://adr.coi.cz/cs). For online dispute resolution, the Buyer can use the EU online platform at http://ec.europa.eu/consumers/odr.

g) The Seller reserves the right to cancel an Event without liability for damages, except for the refund of the ticket price. This may happen if the Seller is forced to cancel the Event due to unforeseen circumstances (e.g., government orders, state of emergency, crisis situation, natural disasters, failure to meet regulatory requirements for organizing such events, etc.).


5. Withdrawal from the Contract

a) According to § 1837(j) of Act No. 89/2012 Coll., the Civil Code, the Buyer does not have the right to withdraw from a Purchase Contract concluded for the use of leisure services at a specific time or date, such as Event tickets.


6. Complaints Procedure

a) All complaints regarding tickets purchased through the Website are governed by these Terms and Conditions and the complaints procedure.

b) Refunds are available only in the cases and under the conditions specified below.

c) The Buyer is not entitled to exchange a ticket. Lost, stolen, damaged, or destroyed tickets will not be replaced.

d) If the ticket is not delivered to the Buyer due to reasons attributable to the Buyer (e.g., spam filters, full mailbox, etc.), the Seller is not responsible.

e) If the Buyer does not receive the ticket within 2 hours of full payment, they must notify the Seller within 48 hours.

f) The Seller will resend the ticket within 24 hours of the Buyer's notice, and no later than 1 hour before the Event.

g) If the Event has already taken place, the Seller will refund the ticket price within 14 days of the Buyer's complaint.

h) If the Event is canceled, the Seller will notify the Buyer (if contact details were provided) and refund the full price.


7. Data Protection

a) The Seller processes personal data in accordance with Article 6(1)(b) of Regulation (EU) 2016/679 (GDPR) to fulfill its contractual obligations. The Buyer’s personal data, such as name, email, phone number, and payment details, are collected only for this purpose.

b) Personal data may be processed to deliver tickets, handle complaints, and send event-related notifications.

c) If the Buyer enters incorrect personal data, they are responsible for contacting the Seller to correct it. Personal data is stored for up to 12 months, unless the Buyer requests its deletion earlier.

d) The Seller may use the Buyer's email address to send commercial messages. Buyers can unsubscribe at any time.

e) Photos and video recordings of Events may be used for promotional purposes. If a Buyer appears in a photo or video, they can request anonymization (e.g., blurring of their face) by contacting the Seller.


8. Final Provisions

a) If any provision of these Terms and Conditions is deemed invalid, the validity of the remaining provisions will not be affected.

b) The Seller reserves the right to change these Terms and Conditions.

c) The contractual relationship between the Buyer and Seller is governed by Czech law.
